The fee that our firm charges for a chapter 7 is decided on a case by case basis, and varies based on several factors including the complexity of the case and the work involved. When doing a $0 down bankruptcy, it adds to complexity and effort on our part if the attorney fees are not fully paid prior to the case being filed. For that reason, we offer all of our clients a discount if they pay all of the attorney fees prior to filing the case. So a Debtor should only take the $0 down option in cases of emergency. What about the $335 filing fee to the court?

In some instances, debtors cannot afford to pay their attorney and/or the bankruptcy court filing fee. The bankruptcy code has a solution for them. If a debtor is eligible (see below for details), they can file an Application to Have the Chapter 7 Filing Fee Waived (Form 103B). Not everyone qualifies.

these are the 4 criteria a debtor must meet before filing this application:

  1. You must be an actual person (businesses cannot file it).
  2. You are filing a chapter 7.
  3. You are unable to pay the fee within 120 days of filing the bankruptcy in installments.
  4. You combined household income is below 150% the line of poverty.

How do I know if I am below the line of poverty

This is the most crucial element of the 4 elements discussed here. To determine whther you are below 150% the line of poverty, you must check the U.S. Department of Health and Human Services (DHHS) website. The line is different depending on your household size.

When you fill out the form, there are many important questions, and you must answer them all honestly. The ask you questions about how much you paid an attorney to help you with the case, and whether you have filed bankruptcy before, and other important questions.
